Terms and Conditions of Sale

1. Seller

Purchases on this site are made from Desportek, trading name of Celia Martinez Fernandez, Entrepreneur individuel, 18 Rue Theodore Botrel, 86000 Poitiers, France, SIRET 10601077000019.

2. Scope

These terms govern the sale of design services, digital deliverables, and design-related physical products offered on desportek.com.

3. Prices

All prices are shown in euros (EUR). Desportek operates under the VAT franchise regime where applicable. VAT: TVA non applicable, art. 293 B du CGI.

Prices may change, but the price shown at the time of order applies to that order.

4. Orders

An order is confirmed once payment is completed and an order confirmation is issued.

For custom design work, the client is responsible for providing a clear brief, brand information, required content, and any assets needed to begin the project.

5. Payment

Payment is processed securely through Airwallex. Accepted payment methods may include major cards and, where available, iDEAL and Bancontact.

Card and banking details are handled by the payment provider and are not stored by Desportek.

6. Delivery of design services

Digital deliverables are provided within the turnaround stated on each service page, counted from receipt of the brief and payment.

Files are delivered electronically by email, download link, or another agreed digital delivery method.

7. Shipping of physical products

Physical items are shipped according to the Shipping and Refund Policy, which sets out carriers, timeframes, shipping fees, returns, and refund conditions.

8. Revisions

Each service page states the number of revision rounds included. Additional revisions may be quoted separately.

9. Right of withdrawal

Consumers in the European Union normally have 14 days to withdraw from a purchase.

For digital services that begin with the client’s express consent before the end of that period, the client waives the withdrawal right once work has started.

Custom-made or personalised goods are excluded from withdrawal.

Standard, unused physical products may be returned within 14 days of delivery.

10. Refunds

Eligible refunds are issued to the original payment method within 14 days of acceptance of the return or cancellation.

11. Intellectual property

On full payment, the client receives the agreed usage rights to the final delivered design.

Source files, working files, unused concepts, rejected concepts, and draft directions remain the property of Desportek unless expressly agreed otherwise in writing.

Desportek may display completed work in its portfolio unless the client requests otherwise in writing.

12. Liability

Desportek delivers services with professional care.

Liability is limited to the amount paid for the order concerned, to the extent permitted by law.

13. Data protection

Personal data is handled according to the Privacy Policy / RGPD.

14. Governing law and disputes

These terms are governed by French law.

Any dispute falls under the jurisdiction of the competent French courts.
